Chapter 3.10 - Appendix B: Adjudication
We'll discuss the role of adjudication in the construction industry, emphasizing its quick and inexpensive nature compared to mediation, arbitration, or litigation. This chapter outlines the provisions of the Ontario Construction Act, which came into force on July 1, 2018, replacing the Construction Lien Act. We'll explore the various matters that can be referred to adjudication, such as valuation of services, payment disputes, holdbacks, and more. Architects may find themselves involved in adjudication either as a party to a dispute or assisting an owner's defense. The decision in an adjudication is enforceable in court and binding until the end of the project.
